My ideal scenario:
1. Congress acts like a bunch of dickbags.
2. Obama sues the assholes, for violation of separation of powers.
3. The court with original jurisdiction is the Supremes. They pick it up.
4. The Court issues a mandamus, telling them to give a straight up or down vote on all appointees within 90 days, both those waiting for years and those who will be appointed in the future.
5. We have courts again!

ReplyDelete4. The court splits 4-4. The ruling of the original appellate court is maintained (without setting national precedent).
5. Everybody looks quizzically at that.

ReplyDeleteI love that Senators are already saying that whoever Obama appoints will be unfit. I would hope that the American people see how this is all about politics and not about the rule of law, but just like the Senators, the public already has its mind made up on this issue, and I am sure it cuts along political lines as well. The funny thing is that the same people that say we should wait, are also the ones that swear by the constitution.
