ReplyDeleteUck. I'm now rethinking having my lawyer be my (conservative) sister. Time to get updated wills and shit. edit: Also give away as much as you can while you are alive. It really helps ensure the right thing is done.
ReplyDeleteLess obvious but an even more important lesson, unless your estate is truly trivial (in estate terms, like net worth in the 10s of thousands) then never name an individual executor. Even if the individual is not a stupid bigot, it is highly unlikely they have a clue how to settle an estate legally.
ReplyDeleteName them as co-exectutor if you must, but individual executors are just asking for trouble.
And if you find yourself named executor, go find an experienced entity (typically a bank trust department) to hire as your agent, (especially if you have busy body family members) because an executor's liability is pretty much unlimited. Hiring an agent shifts the vast majority of that liability to a corporate entity.
One of the big reasons you have a will is so your surviving family doesn't turn knives on each other in carving up your estate. Oh lord is it a mess when moneyed folks die without a will.
